RECOMMENDED ACTION (Motion):

Revise the existing Behavior Policy to enable staff to exclude people who harass others in the library

 

BACKGROUND:

 

Currently harassment as defined in ORS 166.065 (see below) and conduct that involves the use of abusive or threatening language or gestures is included in Rule 1. of the Behavior Rules for the Use of Oregon City Public Library. Because of that, the established protocol is to educate and warn the patron before excluding them from the Library. While the Library never wants to exclude anyone, they also need to be able to respond appropriately to a situation. Staff is finding that these behaviors listed above may warrant a more severe response. However, the policy is written in such a way that education and warning are initially required in these circumstances. Staff proposes to move the highlighted policy language so that it is in alignment with other similar behaviors. The proposed language and revisions are highlighted in the attached document. There are some additional small changes which will be reviewed at the Library Board meeting.

 

2017 ORS 166.065¹

Harassment

(1) A person commits the crime of harassment if the person intentionally:

(a) Harasses or annoys another person by:

(A) Subjecting such other person to offensive physical contact;

(B) Publicly insulting such other person by abusive words or gestures in a manner intended and likely to provoke a violent response; or

(C) Distributing a visual recording, as defined in ORS 163.665 (Definitions), of the other person engaged in sexually explicit conduct, as defined in ORS 163.665 (Definitions), or in a state of nudity, as defined in ORS 163.700 (Invasion of personal privacy in the second degree), when the other person is under 18 years of age at the time of the recording;
