RECOMMENDED ACTION (Motion):
Approve Resolution No. 19-38, Amending the City’s Transportation System Development Charge Discount Zone.

BACKGROUND:
A request has been made to change the border of the Transportation System Development Charge (TSDC) Discount Zone to include buildings which encompass addresses 601, 603, 605, 617, 619, and 621 High Street.

The Discount Zone was first implemented in 2009. The original zone included the Mixed Use Downtown Development Zones and properties directly adjacent to 7th Street and Molalla Avenue from High Street to Highway 213. The TSDC Discount Zone was last amended and approved with the update of the Transportation SDCs in Resolution 18-05 that became effective July 1, 2018. At that time, the zone was changed to include the Willamette Falls Downtown District.

The zoning designation of properties included in the Discount Zones are mostly Mixed Use Commercial (MUC-1 and MUC-2) and Mixed Use Downtown (MUD). The 3 parcels which include addresses 601, 603, 605, 617, 619, and 621 High Street are zoned Mixed Use Commercial (MUC-1).

Resolution 09-02 originally designated the Discount Zone based on an analysis from FCS Group which made the following recommendation:

"In order to ensure that the developments within the regional center or any applicable sections of Molalla Avenue experience the reduction in vehicle trips that is embedded within the TSDC charge structure, the City should consider a policy of providing... TSDC adjustments only for permitted uses in the regional center or on Molalla Avenue."

7th Street has been interpreted as an extension of Molalla Avenue which is why it is also included in the Discount Zone. The Oregon City Elevator is officially designated as a vertical street, an extension of 7th Street.
