RECOMMENDED ACTION (Motion):

Provide final direction to staff on refinements to the mobile food cart regulations.

 

BACKGROUND:

New code amendments for transitory and non-transitory mobile food carts went into effect on August 2, 2019.

 

Just prior to and following the effective code amendments, Oregon Mobile Food Association (OMFA) provided testimony and recommended changes to the adopted code to assure that the city's code language is consistent with state regulations and industry standards and definitions, while assuring that mobile food carts meet Oregon City's Site Plan and Design Review and public works utility standards. Planning and Public Works staff worked with the OMFA to refine the proposed code amendments.

 

Currently transitory mobile food carts are permitted in the following districts through a Type I permit:

- Mixed-Use Employment

- General Industrial

- Campus Industrial

- Mixed-Use Downtown District (outside of the Design District)

- Willamette Falls Downtown District

 

Currently permanent (i.e. non-transitory) mobile food carts are permitted in the following districts through a Type II land use review:

- Willamette Falls Downtown District

- Institutional District.

- Also, the Commission previously directed that permanent mobile food carts also be permitted in the Mixed-Use Downtown District (outside of the Design District)

 

Staff has also worked to revise many of the language and standards related to mobile food carts. A draft of the proposed changes is enclosed. If City Commission supports the proposed amendments, staff will include the changes in the draft of the code amendments for consideration and at the October 16, 2019 hearing.
