Intergovernmental Agreement with the Oregon Department of Transportation for Fence Bolt Maintenance Along OR 99E and the McLoughlin Promenade

RECOMMENDED ACTION (Motion):
Authorize approval of an Intergovernmental Agreement (IGA) No. 32784 with the Oregon Department of Transportation (ODOT) for Fence Bolt Maintenance along OR 99E and the McLoughlin Promenade.
BACKGROUND:
OR 99E, also known as McLoughlin Boulevard, is an ODOT facility. In 1995, ODOT constructed the “Oregon City - Coalco Sec Pacific Highway East” project that installed the mesh fencing and associated anchoring system along OR 99E. This safety project was constructed to mitigate falling rocks from the rock bluff located within this corridor.
During work related to the recent “OR 99E: Rockfall - Oregon City Tunnel to Old Canemah Park” rockfall mitigation project, it was determined that the maintenance responsibility line between ODOT and the City of Oregon City is the edge of the bluff. More specifically, ODOT is responsible for maintenance along the vertical face of the bluff and Oregon City is responsible for maintenance along the horizontal surface at the top of the bluff. Based on this, it was determined that the existing mesh fencing is partially located on Oregon City maintained property and that portions of the anchoring system extend into Oregon City maintained property, specifically along the McLoughlin Promenade.
The City agrees that ODOT maintenance of the mesh fencing system is in the best interest of the public. Additionally, it is acknowledged that in the future ODOT may need to install rock bolts, used to secure large loose rocks, into the face of the bluff which may extend back into property maintained by the City. Staff has determined that work related to maintenance of the mesh fencing, including any necessary rock bolting in the future, is based on safety of the travelling public located below this bluff on OR 99E.
