Resolution No. 19-09, Rescinding Resolution 19-04 which Identified Conditional Support for the Oregon City School District Request to Expand the Urban Growth Boundary

Staff recommends the Comission adopt Resolution No. 19-09.
BACKGROUND:
The Oregon City School District was previously taking steps to prepare an application to Metro, our regional government, to expand the urban growth boundary (UGB) by approximately 32 acres north of Holcomb Elementary School. The application would have been the first of multiple steps to request construction of a middle school located on Forsythe Road in unincorporated Clackamas County and is adjacent to the City limits of Oregon City and the UGB.
The proposal was discussed at the January 16, 2019 City Commission work session and on February 6, 2019, the City Commission approved Resolution 19-04. The Resolution expressed general support for the School District’s selection of the Serres Property as a location for a new middle school and the School District’s application for a Major Amendment to the UGB to include the site but its support is conditioned upon the site being used only for a middle school and, in the event that it is not, the School District shall withdraw the property from the UGB if the property is not annexed and zoned to accommodate a school use within 10 years. The Resolution also authorized the Community Development Director to complete Metro’s Request for Comment from Service Provider document necessary for a major UGB amendment application.
The School District decided to no longer pursue the application process to expand the UGB and therefore did not submit an application to Metro within the required timeframe. As there is not an application under consideration for the City Commission to support, approval of Resolution 19-09 would resind the previously approved Resolution 19-04.
