RECOMMENDED ACTION (Motion):
Staff recommends that the City Commission adopt Resolution No. 18-41, along with the Solid Waste Collection and Disposal Rate Schedule set forth in Exhibit B effective January 1, 2019.

BACKGROUND:
Ordinance No. 06-1001 was adopted February 1, 2006. Under Ordinance 06-1001, an agreement was entered into between the City of Oregon City and the Oregon City Garbage Company, Inc. (dba B&B Leasing) and the City proceeded to develop OCMC 18.20 Solid Waste Collection and Disposal. Under OCMC Chapter 8.20.030 Oregon City Garbage Company is granted an exclusive right, privilege and franchise to provide solid waste collection and disposal services within Oregon City.

OCMC Chapter 8.20.130 provides that rates shall be approved by the City Commission and the commission shall establish and, as considered necessary from time to time, change rates by resolution. The Franchisee is currently requesting a rate increase due to the increased cost of recycling and providing garbage collection services. In determining the appropriate rate to be charged by the franchisee, the City Commission shall consider all appropriate factors, including the following:

A. The cost of performing the service provided by the franchisee;
B. The anticipated increase in the cost of providing this service;
C. The need for equipment replacement and the need for additional equipment to meet service needs; compliance with federal, state, local law, ordinances and regulations; or technological change;
D. The investment of the franchisee and the value of the business and the necessity that the franchisee has a reasonable rate of return;
E. The rates charged in other cities of similar size within other relevant jurisdictions for similar service in comparable service areas;
F. The public interest in assuring reasonable rates to enable the franchisee to provide effi...
