Deed of Dedication of a Washington Street Tax Lot as Street Right-of-Way

RECOMMENDED ACTION (Motion):
Approve and execute the Deed of Dedication as street right-of-way a tax lot located within Washington Street, Tax Lot 2500 of Tax Map 2-2E-29CC.
BACKGROUND:
Tax Lot 2500 of Tax Map 2-2E-29CC is a tax lot totally within the Washington Street right-of-way. This tax lot was constrained with a charter park overlay designation following the adoption of Ordinance No. 03-1010, effective November 14, 2003.
City staff consulted with the City Attorney regarding this park overlay designation and it was agreed that Ordinance No. 03-1010 incorrectly identified Tax Lot 2500 as Abernethy Creek Park. Ordinance No. 18-1022 was prepared and correctly identifies Abernethy Creek Park as Tax Lots 2200, 2301, 2302, 2303, 2304 and 4100 of Tax Map 2-2E-29CC. Ordinance No. 18-1022 will be adopted on September 19, 2018, and with the execution of the attached deed, Tax Lot 2500 of Tax Map 2-2E-29CC can be extinguished and absorbed as road right-of-way.
