Clackamas Community College Meyers Road Cost Sharing and Improvement Agreement

RECOMMENDED ACTION (Motion):
Authorize the City Manager to execute the Meyers Road Cost Sharing and Improvement Agreement with Clackamas Community College.
BACKGROUND:
In 2008, Clackamas Community College (CCC) obtained Concept Master Plan approval authorizing future college development under City file CP 07-01. This approval included condition 4 that required the college to dedicate and construct Meyers Road from Highway 213 to the eastern property of the campus. This condition was placed to mitigate peak hour congestion at the existing Highway 213 and Molalla Avenue entrance for the campus.
In 2015, the City, in collaboration with CCC and the Oregon City School District, jointly funded and completed the Meyers Road Concept Plan work which identified the Meyers Road preferred alignment and cross section.
With the construction of the CCC Industrial Technology Center and the pending construction of the DeJardin Science Complex, the Meyers Road extension is now a requirement for the CCC Master Plan. The City desires to construct the Meyers Road Extension Project as one project, including the portion identified for improvement by CCC. In order to do this, the parties have agreed to enter into this cost sharing and improvement agreement which outlines the costs to be paid by CCC and the responsibilities of each party related to the Meyers Road Extension Project. The agreement addresses the following items:
• Scope of Work, including a table of cost allocations for Meyers Road
• Dedication of Meyers Road right-of-way
• Transportation System Development Charges and associated credits for right-of-way greater than a local street
• Necessary Land Use or Permit Approvals
• Proportional Share of Costs which includes payment of $2,637,712 from CCC to Oregon City for CCC share of costs to construct Meyers Road
• Cross Access Easement for the adjacent property south of Meyers Road
• Tree Removal and Mitigation
• Bonneville Power Administration (BPA) Power Line Clearance
• Relocation of the CCC 36” storm line that is in conflict with the proposed gravity sewer line in Meyers Road
• Rerouting of the existing Shared Use Path on CCC property
• DirectLink Communications Relocation
• CCC Connection Road
Staff from CCC and the City have worked together to come to an agreement that benefits both parties and allows the Meyers Road Extension Project to move forward as one project rather than two projects occurring concurrently. On June 27, 2018 the Clackamas Community College District Board of Education adopted Resolution No. R17/18-45, effective June 27, 2018, authorizing the college to enter into the Meyers Road Cost Sharing and Improvement Agreement.
BUDGET IMPACT:
This agreement is reached understanding that the City will complete the Meyers Road Extension project. Final plans and details are underway and the project is anticipated to begin construction in 2019. This agreement on its own does not have an impact to an Oregon City budget.
