RECOMMENDED ACTION (Motion):
Authorize the City Manager to sign an Intergovernmental Agreement (IGA) with ODOT to provide construction project funding and contract oversight and management on the Hwy 99E MP 12.56 and Main Street Pavement Repair (Main Street Rail Removal Project).

BACKGROUND:
Highway 99E (Hwy 99E) is a part of the Oregon highway system under the jurisdiction and control of the Oregon Department of Transportation. Main Street is a part of the Oregon City street system under the jurisdiction and control of Oregon City.

ODOT Rail required that Union Pacific close rail crossing C-755.44-C (USDOT Crossing 760021P), and this required the removal of the railroad tracks in Highway 99E at mile point 12.56. Union Pacific has performed the work required to remove their railroad tracks, and ODOT has contracted and completed the pavement repairs in Highway 99E where the railroad tracks were removed.

Oregon City also required that the associated railroad tracks in Main Street between Hwy 99E and 6th Street be removed. The City asked ODOT to facilitate the contract for the necessary repair work for Main Street as part of this combined project. Under this agreement, ODOT contracted the repairs for Hwy 99E and Main Street together, but the cost for each segment of the project was tracked separately. Per discussions with ODOT, Oregon City would pay for the pavement repair, striping removal, traffic loops, striping and traffic control necessary for the work on Main Street, and ODOT will pay for all associated expenses for Highway 99E. The total project cost is $188,132. The project cost for the Main Street segment is $96,742.
