Amendment to an Existing Intergovernmental Agreement with Other Cities for the Performance of a Portland General Electric Fee Review and Analysis

RECOMMENDED ACTION (Motion):

Authorize the Public Works Director to sign an amendment to an existing Intergovernmental Agreement (IGA) to complete a multi-agency Portland General Electric (PGE) fee review and analysis.

 

BACKGROUND:

In order to share costs and decrease individual financial impact, the cities of Oregon City, Salem, Milwaukie, Sandy, and Gladstone entered into an Intergovernmental Agreement (IGA) in 2017 to review and potentially update PGE franchise fees which have not been reviewed since 2001. The group identified within this IGA is known as the Right of Way Accountability Coalition (ROWAC).

 

The amendment to this existing IGA does not make any substantial changes. It does, however, add an additional year to the scope of the review, allowing the consultant to analyze the right of way fees paid by PGE for up to three calendar years (2015, 2016, and 2017). The original IGA agreement only authorized review for two years.

 

Staff is recommending that this IGA amendment be approved to allow a review of PGE’s fee payments for the calendar years 2015, 2016, and 2017.
