RECOMMENDED ACTION (Motion):
Authorize the City Manager to execute the Contract Agreement with Brown Contracting, Inc. in the amount of $333,423.00 to provide construction services for the 12th & Washington Traffic Signal Installation Project.

BACKGROUND:
The City executed a Personal Services Agreement (PSA) with KPFF Consulting Engineers in September 2016 to design and prepare contract documents for installation of a traffic signal at the intersection of 12th Street and Washington Street. In November 2017, staff solicited bids for the project in accordance with City and State contracting procedures.

Four bids were received. The City and KPFF Consulting Engineers have reviewed the bids and determined the apparent low bidder, MAK Electric Group Corp., to be non-responsible. OAR 137-049-00390(2) Determination of Responsibility, requires the Contracting Agency to determine that the Offeror has completed previous contracts of a similar nature with a satisfactory record of performance. Although they did submit the Section II O Qualification of Bidder, it did not contain any qualifying experience that provides previous contracts of a similar nature with a satisfactory record of performance.

Brown Contracting, Inc. is determined to be the lowest responsive and responsible bidder. The four bids received and the engineer's estimate are listed below:
