Oregon City Transportation System Development Charge Analysis and Municipal Code 13.20 Proposed Updates

RECOMMENDED ACTION (Motion):
Staff will present the Commission with information regarding Oregon City Transportation System Development Charge (TSDC) Analysis including efforts to update the TSDC Project list(s), the project cost estimates, analysis of other possible methodologies, and consideration of other policy concerns related to the TSDC Code.
BACKGROUND:
In April 2009, the City Commission adopted Resolution No. 09-02 establishing a new Transportation System Development Charge (TSDC) methodology, amounts and implementation schedule, including the City’s Transportation Capital Improvement Plan (CIP) project lists, pursuant to ORS 223.309(1). This list guides how funding can be spent and when developers can seek credit.
In 2013, the City updated our guiding document, the Transportation System Plan (TSP), which included an updated list of roadway, bicycle, pedestrian, and family-friendly projects. That list of projects was never adopted as the Transportation Capital Improvement Plan project list. Additionally, various ancillary transportation documents have been completed, which are also included in this update:
• South End Concept Plan in 2013, which included a refined list of transportation and bicycle/pedestrian projects;
• Willamette Falls Legacy Project in 2014, which included a new bicycle/pedestrian project and safety improvements at the intersection of Railroad Avenue & Highway 99E;
• Linn Avenue, Leland Road, and Meyers Road Corridor Plan in 2015, which included a refined list of transportation, bicycle, and pedestrian projects; and
• Meyers Road Extension Concept Plan in 2015, which established a concept for connecting Meyers Road from Highway 213 to High School Avenue.
Each of these documents and the projects included in them have been through a public involvement process. In several instances, the projects are considered Qualified Public Improvement Projects as defined under Oregon City Municipal Code (OCMC) 13.20.020.
With the attached presentation, staff will recap the City’s TSDC background, provide SDC comparison information, provide details of the project list updates, and cover the impacts of the project needs as related to TSDC rates for residential and non-residential customers. The City’s SDC analysis consultant, FCS Group, will be on hand to explain and answer questions regarding methodology and specifics about regional comparisons and policy related to SDCs.
As a preface to the work session and to give additional detail, the attached 2018 Transportation Project List has been provided for consideration to replace the previous 2009 TSDC Project List - Road Improvements (Table 4) and the 2009 TSDC Project List - Bike/Ped Improvements (Table 5) list. The attached 2018 Transportation Project List includes all projects identified in the TSP as "Likely to be Funded," projects added through ancillary transportation documents completed once the TSP was adopted, projects located near active development opportunities, and other projects determined a priority by the City. The 2018 Transportation Project List and corresponding maps are attached as Exhibits 1 & 2.
