RECOMMENDED ACTION (Motion):

Approve and authorize the Mayor and City Recorder to execute the Restrictive Covenant Non-Remonstrance and Public Sanitary Sewer Connection Agreement for the onsite private wastewater septic system repair permit at 13496 Gaffney Lane.

 

BACKGROUND:

The Restrictive Covenant Non-Remonstrance and Public Sanitary Sewer Connection Agreement provides a waiver of any and all rights to remonstrate against the formation of a Local Improvement District by the City of Oregon City for the purposes of making various sanitary sewer improvements that benefit the property and assessing the cost to the benefited property. Also this agreement provides the requirement that the property connect to the public sanitary sewer when public sanitary sewer collection facilities are reasonably available to the property.  The agreement will be executed in consideration of not requiring extension of the public sanitary sewer system at this time due to physical constraints in the unimproved public right-of-way and allowing for repair of the onsite wastewater septic system. Extending a public sanitary sewer main from the existing sanitary sewer main in Glenview Court is not reasonable until the public right-of-way is improved with future development, at which time the property will be required to connect to the public sanitary sewer system.
