RECOMMENDED ACTION (Motion):

Staff recommends that the City Commission approve proposed Resolution 16-12.

 

BACKGROUND:

Clackamas County Fire District #1(CCFD#1) - Station 16 is located at 19340 Molalla Avenue and provides fire and emergency services to significant portion of the City. Station 16 has developed a mold infestation that has contaminated portions of the station and makes it uninhabitable and not capable of housing the Firefighters or to be used for its intended purposes.  CCFD#1 is diligently working to determine the cause and extent of the mold as well as a mitigation and implementation plan to remedy the situation.  In the interim period, it is necessary to allow temporary modular units to be placed on the property to maintain the desired response times to the community being served from this location. 

 

Section 2.52 - Emergency Powers of the Oregon City Municipal Code authorizes the CIty, in cases of emergency to order such other measures as are necessary for the protection of life or property, or for the recovery from the emergency.  By declaring the emergency, the City Commission will be granting to CCFD#1 an exemption from the Oregon City Zoning Code for the placement of temporary modular structures on the site for the duration of the emergency and the payment of System Development Charges for the temporary modular structures, provided CCFD#1 complies with the setbacks of the zoning district and obtains the necessary Building Department permits and approvals.  The emergency declaration for 19340 Molalla Avenue will be in effect for 24 months.
