Resolution No.16-10, Calling for an Election in November Referring the Question of Banning Marijuana Facilities within the City of Oregon City

RECOMMENDED ACTION (Motion):

Staff recommends approval of Resolution No. 16-10 and authorizes the City Manager to file the ballot title with the City Recorder.

 

BACKGROUND:

The City Commission will be asking Oregon City voters if the establishment of medical marijuana processors, medical marijuana dispensaries, recreational marijuana producers, processors, wholesalers, and retailers should be allowed in the City.  The City Commission had previously passed Ordinance 15-1017 on November 4, 2015, prohibiting such uses so that Oregon City voters may have a local discussion and review of the matter.  House Bill 3400 requires any such ordinance prohibiting such activities to be submitted to the voters of the City.  This shall be referred to the electors of the City of Oregon City at the next statewide General Election on Tuesday, November 8, 2016.

 

The City is developing reasonable time, place and manner regulations to allow a permitting process for marijuana businesses that will be adopted through a separate public legislative process.
