RECOMMENDED ACTION (Motion):
Adopt the Property Deed for Tract A (Stormwater Facilities) of the Lindsay Anne Estates subdivision project and authorize the City Manager and City Recorder to execute this deed document.
BACKGROUND:
The City's stormwater detention/water quality pond facilities are required to be publicly owned and maintained property for stormwater management purposes.
The Lindsay Anne Estates subdivision project is creating a stormwater pond within the above mentioned Tract A. Normally this tract would be simply conveyed to the city as stated in a plat note (as the plat records so would the conveyance be done).
This process has recently been changed by the Clackamas County Surveyor's Office. Now a separate property deed is required. After this deed is executed it is recorded with or after the plat. The deed recording document number is then referenced on the plat.
