RECOMMENDED ACTION (Motion):
Staff recommends adoption of Resolution No. 15-10, authorizing the City Manager, or his/her designee, to accept deeds of dedication of land in fee, as easements, or covenants required as conditions to a land use approval previously granted by the City.
 
BACKGROUND:
As part of the land use review process, the City may require landowners to dedicate or otherwise transfer property to the City for public uses, including, but not limited to, stormwater facilities, streets, roads, utility easements, public squares and other improvements.  The Clackamas County Surveyor is now requiring a deed to be executed between the landowner and City to recognize conveyances for land in fee that are requirements of the land division process.  The Oregon City Commission, as the governing body of the City of Oregon City, typically reviews and accepts dedications and other transfers of land.   
 
Every deed used to transfer land as the result of a land use approval does not require review and acceptance by the City Commission, as the review process has already been accomplished by the applicable land use approval process including, but not limited to, a land division, a conditional use, or a site plan and design review approval process.  The City Manager, or his/her designee shall be given the ability to review dedications and other property transfers resulting from land use approvals to ensure they meet the public interest.
