RECOMMENDED ACTION (Motion):
City Commission approve second reading and adoption of Ordinance No. 14-1010 for the vacation of a 26-foot wide public alley located between lots 2 and 3 and lots 6 and 7 of Block 117 of the "Oregon City" subdivision.
 
BACKGROUND:
The Barclay School is built on Block 117 of the "Oregon City" subdivision and the northerly wing of the old Barclay School is built over a section of the public alley.  In 1974, Oregon City Ordinance No. 1814 was recorded for the vacation of certain street and alley sections to facilitate the development of the Barclay School site and neighboring properties.  However, the described 26-foot wide public alley was not included in the 1974 ordinance and thus the alley still exists as a public right-of-way.  
 
The Block 117 as developed will continue to house the Barclay School and the alley serves no public purpose and should be vacated (no easements retained).
 
On August 6, 2014, Resolution No. 14-20 was adopted and executed for the initiation of the vacation of the above described public alley.  
 
The City Commission approved the first reading of Ordinance No. 14-1010 at its regular meeting on September 3, 2014.
