RECOMMENDED ACTION (Motion):
Staff recommends that the City Commission approve the McLoughlin Boulevard Improvements Agreement with Oregon City Center, LLC.
 
BACKGROUND:
The Oregon City Center, LLC Owner received site plan and design review land use approval for improvements to the Oregon City Shopping Center, which is located at 1900 McLoughlin Boulevard.  The property currently has a driveway access from the SE Frontage Road (aka: Firestone Alley), which is part of the right-of-way of McLoughlin Boulevard, under the jurisdiction of the Oregon Department of Transportation.  Improvements to this access were required as part of the land use approval.  The property also has frontage along McLoughlin Boulevard where the City is in the pre-construction and design phase of the McLoughlin Boulevard Enhancement Phase 2 improvements.  
 
The Owner and the City agree that incorporating improvements to the Owner's access and SE Frontage Road into the City project design and construction would meet the needs of both the Owner and the City based on the size and complexity of the project.  The proposed McLoughlin Boulevard Improvements Agreement sets out the obligations of the City and the Owner in working together on a consolidated project.  In general, the City agrees to be responsible for the design and construction of the improvements at the SE Frontage Road and the sidewalk on the east side of McLoughlin Boulevard/Dune Drive intersection. The Owner agrees to obtain the necessary ODOT access and construction permits and to complete the parking lot and landscaping improvements on the property.  
 
The proposed IGA has been agreed to by the Owner and reviewed by the Assistant City Attorney and Community Development Director.
