RECOMMENDED ACTION (Motion):
Adopt the Staff Report with Exhibits and the attached Proposed Findings, Reasons for Decision, and Recommendations for File AN 12-04.
BACKGROUND:
Following a public hearing to consider the proposed annexation on July 23, 2012, the Planning Commission voted to recommend approval of AN 12-04 to the City Commission.
The applicant is seeking to annex one (1) parcel into the City of Oregon City.  The parcel is currently located within unincorporated Clackamas County, inside the Portland metropolitan area Urban Growth Boundary (UGB), and within the Urban Growth Management Agreement (UGMA) Area of Oregon City and Clackamas County. The address is 14362 Maplelane Court. The area is comprised of one (1) tax lot for a total area of approximately 0.89 acres.  The property is part of the original UGB (1979).
All annexations are subject to review by the City Commission against the approval factors in OCMC 14.04.060. All annexations must be approved by the legal voters of Oregon City following approval by the City Commission.
Staff has prepared a Staff Report with recommended findings for consideration by the City Commission. By adopting the staff report and attached findings, reasons for decision, and recommendations for File AN 12-04, the City Commission determines that the proposed annexation demonstrates a positive balance of the factors set forth in section 14.04.060 the Oregon City Municipal Code. This constitutes the City's "land use decision" regarding the proposal.
To forward the annexation to the legal voters of Oregon City, staff has also prepared a separate resolution setting the election date and ballot title for adoption by the City Commission this evening as a General Business item.
