RECOMMENDED ACTION (Motion):
Staff recommends that the City Commission approve Local Agency Agreement No. 30259 Between Oregon Department of Transportation (ODOT) and City of Oregon City - For Federal-Aid Surface Transportation Program Funds to Design and Construct Improvements and for Long Term Maintenance Responsibilities for McLoughlin Boulevard Enhancement Project Phase 2 [aka OR99E: Clackamas River Bridge - Dunes (Oregon City)].
BACKGROUND:
In May 2012, the Oregon City Urban Renewal Commission approved the final version of Local Agency Agreement No. 28220 between the State of Oregon, Department of Transportation and the Oregon City Urban Renewal Commission that establishes agreement terms for the funding, design and construction of the McLoughlin Boulevard Enhancement Project Phase 2 [aka OR99E: Clackamas River Bridge - Dunes (Oregon City)].
Previously tonight the Oregon City Urban Renewal Commission was presented the Local Agency Agreement No. 30259 between the State of Oregon, Department of Transportation, and the Oregon City Urban Renewal Commission and the City of Oregon City only for termination of Local Agency Agreement No. 28220 between the State of Oregon, Department of Transportation and Oregon City Urban Renewal Commission.
Local Agency Agreement No. 30259 between the State of Oregon, Department of Transportation and Oregon City Urban Renewal Commission and the City of Oregon City restates the project execution terms (including special provisions) associated with project funding and project management. In addition to the terms included in agreement 28220. it also includes agreement terms for the long term maintenance responsibilities resulting from the project.
This Agreement (No. 30259) identifies long term maintenance responsibilities and replaces Local Agreement No. 28220 that addressed funding for design & construction improvements and Local Agreement No. 11119 for the long term maintenance of the intersection improvements. This agreement identifies long term maintenance responsibilities with the City taking responsibility for the following items within the ODOT right-of-way:
· Payment of the power costs for the Hwy 99E & Dunes Drive signal, video detection & attached illumination
· Maintenance of ornamental fencing, ornamental street illumination and power for ornamental street illumination
· Maintain all grassed and landscaped areas, including planter strips, plantings, trees, tree wells, unit pavers, landscaped medians and permanent underground irrigation, this includes all pruning necessary to maintain safe stopping sight distances
· Maintenance of sidewalk & curbs due to damage by street tree roots, and remove tree leaves from inlets & curb gutter lines that block stormwater flow
· Graffiti removal from project areas
· Maintenance of water quality and stormwater facilities including gateway landscape architectural features within the City right-of-way
· Maintenance of Plaza Gateway, Dunes Drive Gateway, and SE Frontage Road connection to OR 99E landscape architectural features, including: fieldstone pavement, steel panels, concrete stairs/handrail, boulders, boulder benches, and concrete terrace seat wall within State right-of-way
