Staff requests a continuance of this item until the November 4, 2015 City Commission meeting.

 

 

BACKGROUND:

This Resolution is intended to validate the designation of the City Commission's understanding of Waterboard Park.  Resolution 15-29 confirms the City Commission's understanding that the entire Operations Facility has never been “designated as a park” and therefore, is not subject to Chapter X of the City Charter.

 

On August 5, 2015, concerns were raised by a citizen related to the history of adopted Comprehensive Plan Zoning for Waterboard Park and whether a comprehensive plan designation served to designate the upper yard area of the Public Works Operations Center as a “park” pursuant to the Oregon City Charter. 

 

At the August 19, 2015, City Commission meeting, the City Commission discussed the history of past Oregon City comprehensive planning as covered in the detailed written response dated August 12, 2015 (attached).  At that meeting the City Commission concluded that the upper yard of the Public Works Operations Center was not a “designated park” pursuant to the charter and asked that Staff bring before the City Commission a resolution confirming that conclusion.

That resolution was scheduled to be heard at the City Commission’s September 16, 2015, meeting, but that afternoon, the McLoughlin Neighborhood Association submitted a cover letter along with a CD containing 572 pages of additional information.  The information generally includes the following documents:

                     The McLoughlin Neighborhood Association submittal letter signed by Mr. Jesse Buss and dated September 16, 2015

                     Oregon City Public Works Facility Plan 2004 meeting notes

                     Oregon City Operations Facility Plan and a variety of the associated land use approval attachments

                     1991 Parks Master Plan and associated adoption documents

                     Portions of the 1998 Parks Master Plan and a variety of adoption documents

                     A map titled Public Ownership Map

 

Staff originally requested a continuance until the October 21, 2015 City Commission meeting, however, the Public Works Director is obligated to present the 2015 American Public Works Association Awards at the Oregon Chapter Fall Conference which is also on the evening of the 21st.  Staff asks that this matter be continued again so that the Department Director can address this issue at the  November 4th City Commission Meeting.
