First Reading of Ordinance No. 20-1008, Amending Chapter 2.30 of the Oregon City Municipal Code (Citizen Involvement Committee)

RECOMMENDED ACTION (Motion):

The CIC recommends approval of the first reading of Ordinance No. 20-1008.

 

EXECUTIVE SUMMARY:

The Citizen Involvement Committee (CIC) requested changes to OCMC 2.30-Citizen Involvement Committee.

 

BACKGROUND:

The CIC is wishing to make changes to OCMC 2.30-Citizen Involvement Committee. The main changes are both members of each Neighborhood Association will be voting members; the CIC Chair will be responsible for putting together the agenda for all meetings, and restoration of the CIC by-laws. There are a few other minor changes being requested. At that time the Commission tentatively agreed with these changes to the Code. Tonight they are being presented for adoption. This agenda item was prepared by Bob LaSalle, Chair of the Citizen Involvement Committee.

 

Oregon City staff recommends the Commission not strike the language "this chapter" from the proposed amendments in 2.30.010 and the word "and" be inserted after. The language as proposed does not provide clear direction that the provisions of the chapter implement the duties of the CIC.

 

Proposed Sentence:

The CIC shall foster public participation and education regarding land use for the citizens ofOregon City on behalf of the city commission and perform other duties as identified within this chapter the CIC bylaws.

 

Planning Division Recommended Change:

The CIC shall foster public participation and education regarding land use for the citizens ofOregon City on behalf of the city commission and perform other duties as identified within this chapter and the CIC bylaws.

 

The Commission should also consider the following sections of the proposed revisions and provide direction.

Section 2.30.030 - Membership has been amended to include the following: "If a member selected by a neighborhood association is not appointed to the CIC it will be informed of the reason for the non-appointment." 

The Mayor has the sole discretion to appoint a CIC member, there are no criteria for such an appointment.  Informing the neighborhood association would be a courtesy, though a justification for non-appointment is not required per the authority granted to the Mayor to make such a decision.  The Commission should provide direction if this amendment should be included or not.

 

Section 2.30.040(B) - Officers and staffing has been amended to include the following: "Staff of the CIC may include a city commissioner liaison and will include a city liaison.

Section 2.30.040(B)2 has been amended to remove the following: "Consistent with the City Charter, the city manager shall retain his/her discretion to suspend staffing when reasonable circumstances warrant."

 

Staff would recommend that neither of these proposed amendments be included.  The decision to assign staff to a committee is the responsibility of the City Manager. Per section 21(C)3 of the Charter "The manager shall designate a city recorder, shall appoint and may remove appointive city officers and employees except as this charter otherwise provides, and shall have general supervision and control over them and their work with power to transfer an employee from department to another. He shall supervise the departments to the end of obtaining the utmost efficiency in each of them. He shall have no control, however, over the commission or over the judicial activities of the municipal judge."  The city manager has the administrative responsibility to manage staffing on behalf of the City, consistent with the charter.  

 

Staff would recommend the following replacement language for Section 2.30.040(B)2 "Consistent with the City Charter, the city manager shall retain her/his discretion to suspend staffing when reasonable circumstances warrant. The city manager shall inform the City Commission and the CIC of the suspension of the City liaison should it occur."
